I was just curious, if someone like myself were to release an "App Store" program is it acceptable for programs on the App Store to contain malicious code?

Somewhere in this dimension... I think.

As long as your app store makes it clear you are not going to assure that all software is non-malicious, and that the app store itself is in no way malicious (and preferably doesn't directly support malicious code) then I don't see what the issue is. The point of the rule was to keep malicious code off of computercraft forums, the most offical place for the code, outside of that trust shouldn't be assumed so I don't see why the rules should be enforced outside of the direct program.

Thanks a bunch for clarifiying, I thought i'd rather be safe than sorry and have staff hassling me about a plethora of malicious code just sitting on the forums. :P/>

As long as you're not linking to those programs in any way, we shouldn't have any reason to moderate your post like that. If your app store does offer malicious code, it's entirely possible that it would be blacklisted on the forums until it no longer provides them.
